Summary

Rockville exempts yard sales by resident property owners from its peddler and temporary-stand license rules, so a homeowner selling from their own yard needs no City permit.

This subsection shall not be interpreted to prohibit yard sales by resident owners of the property, sales by minors under the age of sixteen (16) years residing on the property or sales permitted by a temporary use permit issued pursuant to chapter 25 (Zoning).(d)The prohibitions in this section may be waived in whole or in part at the sole discretion of the City Manager if he finds that such a waiver is in the best interests of the City, and that the activity:(1)Will not adversely affect the health, safety or welfare of City residents;(2)Will not violate the spirit of this chapter; and(3)Will not be in conflict with any other applicable law. (Laws of Rockville, Ch. 27, §§ 2-504, 2-505(c); Ord. No. 6-09, § 2, 3-9-09)

Full Breakdown

The City's hawkers-and-peddlers ordinance bars selling from a temporary stand, vehicle, or unimproved lot without a peddler license, but Sec. 12-191(c) carves out yard sales by resident owners of the property, sales by minors under sixteen residing there, and sales under a zoning temporary-use permit. A resident holding a garage sale on their own property therefore doesn't need a peddler's license, badge, or City Manager waiver: the exemption applies automatically. Anyone selling outside that exemption, such as a non-resident vendor setting up a stand, still needs a license under Article VII.

Violations & Fines

No permit means no violation for a resident-owner yard sale: it's expressly exempt. Selling outside the exemption without a peddler license is a municipal infraction under § 12-191.
