Full Breakdown

Sioux City Municipal Code § 4.56.020 exempts residents from the city's transient merchant license when they sell personal property at a garage, basement, or yard sale held on their own premises, but caps it at two sales per 12-month period, each running no more than two consecutive days and only between 8:00 a.m. and 8:00 p.m. The zoning code separately confirms individual garage sales don't need a temporary use permit (§ 25.02.210), though they must still meet the noise-control and litter standards that apply to neighborhood events under that section. Exceed the frequency cap and the activity is treated as unlicensed transient merchandising.

Violations & Fines

Running more than two garage sales in 12 months, exceeding the two consecutive-day limit, or selling outside 8 a.m.-8 p.m. forfeits the exemption; unlicensed transient merchant activity is punished under § 1.04.100, with each day a separate offense.
