Summary
Nampa's fence permit only proves compliance with the city's own fencing rules. HOA covenants are a separate, unenforced layer the city leaves entirely to the subdivision.
Recognizing that many subdivisions/properties have private covenants, codes and restrictions that in part govern the type, placement, height and appearance of fences, a fence permit as issued by/from the City of Nampa shall not be construed to be an abrogation of a property owner's responsibility to comply with pertinent, private covenants. The City of Nampa, accordingly, shall undertake no efforts to enforce any fence provisions stated in private covenants, but shall only enforce the fence code as contained within this title and chapter.

Full Breakdown
Nampa City Code § 10-1-8.D.3, in the fences-and-walls section, states that many subdivisions have private covenants, codes and restrictions (CC&Rs) governing fence type, placement, height and appearance. A city fence permit does not excuse a property owner from complying with those private covenants, but the city also will not enforce them. Nampa's building division enforces only the fence standards written into Title 10, Chapter 1 of the city code; anything an HOA adds on top (stricter height limits, material or color restrictions, design approval) is a private civil matter between the owner and the HOA, not a code-enforcement issue.
Violations & Fines
City fence code violations go to Nampa code enforcement under the nuisance-abatement process (City Code § 3-4-2); HOA covenant violations are enforced only by the HOA through its own governing documents and civil remedies, not by the city.
