Official source re-checked September 7, 2026: no newer edition of the code had been published (publisher’s edition: Code of Ordinances: Supplement 65).
Full Breakdown
Under the Development Code's subdivision standards, LCG states flatly that it does not enforce the private provisions within covenants or deed restrictions recorded on a subdivision plat. Developers may still be required to submit deed restrictions or covenants for public protection and maintenance of the development, and those get referenced on the final plat, but enforcing violations of the CC&Rs themselves is left to the subdivision's homeowners association or lot owners through civil action, not city or parish code enforcement. This applies the same way in both the City of Lafayette and unincorporated Lafayette Parish, since Article 3 of the Development Code governs both. It does not apply in Broussard, Carencro, Duson, Scott, Youngsville, or Milton, which operate under their own municipal codes.
Violations & Fines
No LCG citation issues for a CC&R breach: an HOA or neighbor must sue in civil court to enforce a covenant or deed restriction.
