Summary
Paulding County's ER Estate Residential District, and several other residential zoning districts, require a mandatory Homeowners Association under UDO Section 210-20.10 whose declarations and bylaws must regulate specific exterior items and private infrastructure. Enforcement of those CC&Rs runs through the HOA itself, separate from the county's own code enforcement of the UDO.
210-20.10 Mandatory Homeowners Association. The ER District shall require a mandatory Homeowners Association. The association shall also include declarations and bylaws including rules and regulations, which at a minimum shall regulate and control the following: A.Exterior items such as fences, lawn ornaments and restrictions on removal of landscaped areas and buffers. Because the UDO only requires that these subjects be addressed "at a minimum" in the HOA's own declarations, the specific fine amounts, assessment procedures and architectural review standards for fences or landscaping are set by the private CC&Rs themselves, not by the county code.

A developer who records a subdivision plat in the ER, R-1, R-2 or R-3 District without establishing the mandatory Homeowners Association and declarations required by Section 210-20.10 and its counterpart sections is out of compliance with the UDO, a matter the Community Development Department enforces at the county level. Disputes over an individual homeowner's fence, lawn ornament or landscaping violation of the HOA's own declarations are enforced by the association, not the county, unless the same condition also violates the county's zoning code.
