Under 68 Pa.C.S. 5302, the recorded declaration may authorize the association to impose fines for CC&R violations. Before levying a fine, the board must typically provide written notice of the alleged violation and an opportunity to be heard at a board meeting. Fine amounts must be set in the declaration or governing rules; the board cannot impose arbitrary penalties. Repeat violations may result in escalating fines. Under 68 Pa.C.S. 5315, unpaid fines become part of the assessment lien and may be collected through the same foreclosure process as unpaid dues. The association may also seek injunctive relief in Allegheny County Court of Common Pleas to compel compliance with covenants. Selective or discriminatory enforcement of CC&Rs can be challenged by homeowners as a defense in court. Owners receive protection under the PA Human Relations Act against discriminatory application of covenants. The statute of limitations for covenant enforcement actions in Pennsylvania is generally five years under 42 Pa.C.S. 5527.
