Section 209.006 requires the association to send written notice of violations including the nature, date, amount of any charges, and a statement of the owner's right to a hearing. Section 209.007 requires the association to hold a hearing before the board (or committee) if the owner requests one within 30 days. Members may be accompanied by counsel and present evidence. After exhausting internal procedures, disputes may go to mediation (often required by CC&Rs), arbitration if agreed, or district court in Tarrant County. Fair Housing complaints alleging discrimination may be filed with HUD or the Texas Workforce Commission Civil Rights Division. Records of hearings should be preserved for three or more years.
