California Health and Safety Code Sections 114365-114365.7 (the Homemade Food Act, AB 1616 as amended by AB 1266 and AB 626) establishes two classes of cottage food operations. Class A cottage food operations sell directly to consumers from the home and require self-certification with the Fresno County Environmental Health Department. Class B operations sell at farmers markets, through third-party retailers, or via the internet and require a permit from Fresno County Environmental Health. As of 2024, annual gross sales are capped at $75,000 for both classes. Approved cottage food products include baked goods, candies, dried fruit, granola, jams, nut butters, pasta, popcorn, and other non-potentially hazardous foods. Products must be labeled with the statement Home kitchen food product, the cottage food operation name and address, ingredients, and any allergen information. In Sanger, cottage food operators must also comply with home occupation zoning provisions, meaning the kitchen operation should not generate commercial-level traffic. No commercial kitchen equipment, commercial exhaust hoods, or structural modifications are required. The Fresno County Environmental Health Division conducts inspections of Class B operations.
