" These caps apply on top of the general rule in Subsection B that a home business in a Residential zone must be conducted entirely indoors, and Subsection G requires the lot to have adequate off-street parking with no home-business vehicles parked on-street. Getting a home business started at all requires a Zoning Permit from the Department of Planning Services, which Appendix 5-J prices at $50 for the Home Business (ZPHB) category, one of the cheapest permits in the county's entire fee schedule. Subsection H makes clear the customer caps do not override a stricter approval requirement elsewhere in the code: any use that already needs a zoning permit, site plan review, or Special Review Permit in its zone cannot be run as a home business without that separate approval.

Exceeding the five- or ten-person customer cap, or hosting clients outside the 7 a.m. to 7 p.m. window, is an unlawful use of land under Sec. 23-10-20, a misdemeanor punishable by up to a $100 fine or 10 days in jail for each day of violation. Sec. 23-10-40 separately allows a civil penalty of $25 to $1,000, plus a continuing penalty of up to $100 per day the violation persists, which the County can pursue in addition to revoking the underlying home business zoning permit.
