Home-based child care in Bexar County is regulated by the Texas Health and Human Services Commission Child Care Regulation division under Human Resources Code Chapter 42 and the Minimum Standards for Child-Care Homes. Three tiers exist. Listed Family Homes care for 1 to 3 unrelated children and must register with HHSC but follow reduced standards. Registered Child-Care Homes care for up to 6 children plus up to 6 school-age kids after school, must pass background checks, complete 30 hours of annual training, and hold current CPR and first-aid certification. Licensed Child-Care Homes allow up to 12 children with at least one assistant and additional floor-space and fire-safety requirements. All providers must complete a pre-application interview, submit fingerprints for FBI and DPS background checks on every adult in the household, maintain immunization records, have working smoke detectors and a fire extinguisher, limit access to swimming pools with approved barriers, and follow safe-sleep rules for infants. Inside San Antonio, homes serving 7 or more children may need a certificate of occupancy. Unincorporated providers need no city approval but still must meet HHSC rules.
