Once you exceed two unrelated children present more than four hours a day, you must be licensed by the NC Division of Child Development and Early Education (DCDEE) under 10A NCAC 09; operating unlicensed is a Class I felony. In unincorporated Buncombe County, a home daycare must also comply with the county's home-occupation zoning standards through Planning.
