Beyond state licensing, your city or village zoning ordinance controls whether and where a home daycare may operate and may require a home-occupation permit. Milwaukee County itself neither licenses nor zones home daycares.
Providing unlicensed care above the threshold exposes a provider to DCF enforcement, forfeitures, closure orders, and potential criminal referral under Wisconsin child care law.
