Winston-Salem home-based child care is regulated primarily by the NC Division of Child Development and Early Education (DCDEE). Family child care homes caring for more than two unrelated children must be licensed by the state. Winston-Salem Unified Development Ordinances (UDO) Chapter B Article IV permits family care homes as a home occupation subject to zoning standards in residential districts.
Under NCGS 110-86, any home caring for three or more unrelated children on a regular basis must obtain a family child care home license from DCDEE. Winston-Salem UDO classifies family care homes as an accessory use in most residential zoning districts (RS-9, RS-15, RS-20 and similar). Operators must secure a zoning use permit from the City-County Planning Department, comply with state fire inspection standards, and pass criminal background checks for all household members over 15. Maximum capacity is eight children including the providers own. Outdoor play areas must be fenced if adjacent to streets or drainage features. Parking for pick-up and drop-off must not obstruct neighbor driveways. The NC Building Code Volume VII applies to family child care homes.
Operating without a DCDEE license is a Class 3 misdemeanor. Zoning violations carry civil penalties starting at 100 dollars per day under Winston-Salem UDO enforcement provisions.
