Unincorporated Jefferson County allows commercial home occupations on residential lots under Zoning Resolution Section 21. The business must be secondary to residential use, not change the property's character, and stay within listed permitted uses; a Miscellaneous Permit is required.
Section 21 (Home Occupations) provides "for the operation of commercial activities on lots, parcels or tracts of land used for residential purposes under certain conditions." Permitted home occupations include craft work, garment work, office facilities for sales reps and consultants with visiting clients, small-appliance repair, tutoring/lessons (no more than one student at a time), art/photography studios, garage sales, and state-licensed small day-care homes. The occupation "shall be clearly secondary to the use of the lot... for residential purposes and shall not change the character thereof." A Miscellaneous Permit from Planning & Zoning is required. No more than two home occupations may operate per residential property.
Operating an unlisted or non-conforming home occupation without approval violates the Zoning Resolution; excluded uses may require Administrative Exception or Board of Adjustment approval, and violations are enforced by Planning & Zoning.
