Section 72-283 is the county's single, current standard for every home-based business in unincorporated Volusia, replacing the old Class A/Class B home occupation split when Ord. No. 2021-34 rewrote it in December 2021. To qualify, a business must operate in whole or in part from a residential property and satisfy every listed criterion. The employee rule in (1) requires that workers at the dwelling also live there, with one carve-out: up to two employees or independent contractors who don't reside on site may still work at the business, plus any number of remote workers who never come to the property.

Volusia does not issue a distinct 'home occupation permit,' but any operator still needs the county's local business tax receipt referenced elsewhere in the Code before opening.
Violations & Fines
A home business that fails these criteria, for example, by employing more than two outside, non-resident workers, or by visibly operating as the dominant use of the property, is a code violation. Following inspection and notice, the Code Enforcement Board can impose fines up to $1,000 per day for a first violation and $5,000 per day for a repeat violation under § 2-365, recorded as a lien against the property until paid.
