Polk County allows home occupations as an accessory use to an existing dwelling in all residential districts, provided the business stays clearly incidental and secondary to residential use and does not exceed 25 percent of the home's ground-floor area.
Under Section 206.E of the Polk County Land Development Code, home occupations may be permitted as an accessory use to an existing dwelling unit in all residential districts, subject to district regulations. The home must be the practitioner's bona fide residence, and the business must be clearly incidental and secondary to residential use. It may occupy no more than 25 percent of the gross habitable ground-floor area, generate no display or outdoor storage, and cause no noise, odor, glare, vibration, or fumes outside the building. At most one non-family employee is allowed. Home occupations located in an accessory structure or garage need a Level 3 Review.
Operating a non-compliant home business, or one on the prohibited list (auto repair, kennels, manufacturing, tattoo/massage parlors, etc.), can trigger Polk County code-enforcement action and fines.
