Waukesha County zoning allows home occupations and professional offices as accessory uses in residential districts when incident to the residential use and conducted in the same dwelling. A business run from a detached garage or accessory building needs a conditional use permit.
The county defines a home occupation as any occupation for monetary gain conducted entirely within the principal residence. Home occupations and professional offices are permitted accessory uses when incident to the residential use and situated in the same dwelling, subject to conditions: no nameplate over three square feet, no more than 20 percent of the principal building's floor area, no more than one non-resident employee, adequate off-street parking, and no retail/wholesale sales or nuisance machinery on the premises. A home business operated in an attached garage or accessory building requires a conditional use permit (Limited Family Business) under Section 3.08(7)(KK). Cities and villages apply their own home-occupation zoning.
Operating a home business that exceeds these conditions, or in an accessory building without a conditional use permit, is a zoning violation subject to correction orders and forfeitures.
