Summary

Lee County allows home occupations by right in every district that permits dwellings. The business must stay clearly incidental to living there, no more than two employees or contractors may work at the residence, and retail sales happen inside.

City-specific rules exist: Fort Myers, and Cape Coral have their own zoning & home occupation permits rules that differ from Lee County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Home occupation means an occupation customarily carried on by an occupant of a dwelling unit as an accessory use which is clearly incidental to the use of the dwelling unit for residential purposes and operated in accordance with the application provisions of Article VII, Division 18 of this chapter.

Full Breakdown

Section 34-1771 states the intent plainly: home occupations are allowed by right in all districts permitting dwelling units, but regulated so the average neighbor is not disturbed. Section 34-1772 carries the standards. The use must be clearly incidental and subordinate to residential use. All retail transactions must be conducted entirely within the dwelling unit. No more than two employees or independent contractors may work at the residence. Nothing you store or display may be visible from the street, and trucks used in the business must comply with Section 34-1181. Chapter 34 applies only in unincorporated Lee County.

Violations & Fines

Exceeding the Division 18 standards is a Land Development Code violation. It can bring a fine of up to $500 per offense in court, or daily fines from the Hearing Examiner starting at $25.
