Summary

Kenosha County allows home occupations and professional home offices only in districts whose regulations list them as permitted, and only after the owner gets a Certificate of Compliance. The business must stay clearly incidental to residential use, capped at 25 percent of one floor, with residents doing the work.

These county ordinances apply to unincorporated areas of Kenosha County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Customary home occupations and professional home offices may be established in a dwelling or accessory building only in those districts which provide for such home occupations and professions. In such districts, the following requirements shall apply, in addition to all other applicable requirements of this ordinance for the districts in which such uses are located: (a) The home occupation or profession shall be clearly incidental to the residential use of the dwelling and parcel and shall not change the essential residential character of the dwelling and parcel so that a typical neighbor would not be aware of such use other than for a permitted sign. (b) Use of the dwelling and parcel for this purpose shall be limited to 25 percent (25%) of one floor of either the dwelling or an accessory building. (h) Residents of the dwelling only may be engaged in the home occupation. In the case of professional offices, no more than one nonresident may be employed on the premises. (m) Subject to the issuance of a Certificate of Compliance as set forth in section 12.05.050 of this ordinance.

Full Breakdown

010(m)). 010(a), requires the business stay clearly incidental to the residential use: a typical neighbor should not notice anything but a permitted sign. 010(b) caps the space used for the occupation at 25 percent of one floor of the dwelling or an accessory building, and subsection (c) bars using any other accessory building for the occupation beyond that allowance. Outdoor storage tied to the business is prohibited outright (d), and non-domestic chemical, mechanical or electrical equipment cannot be used for commercial purposes except medical or dental equipment for a professional office (e).

Machinery that causes noise or radio/TV interference is banned (f), and no interior or exterior alteration inconsistent with the residential look of the building is allowed (g). Only residents of the dwelling may work in the home occupation, though a professional office may add one nonresident employee (h); no product display may be visible from the street and only articles actually made on the premises may be sold there (i). 020 lists examples the county treats as automatically permitted, such as artist studios, dressmaking, computer services, taxidermy and licensed gunsmithing with no ammunition sale or discharge on site, and flatly prohibited uses such as auto or small-engine repair, catering, contracting services, welding, tattoo/piercing and landscaping businesses. 010, also caps vehicle traffic, instruction group size and signage, each governed by its own subsection.

Violations & Fines

Operating a home occupation without the required Certificate of Compliance, or violating any condition of Section 12.21.010, is enforceable under Kenosha County Code Section 12.53.010: a forfeiture of $10 to $500 plus prosecution costs and attorney fees, with each day of continued violation a separate offense, and up to 30 days in the county jail if the forfeiture goes unpaid.

Frequently Asked Questions

Do I need a permit to run a home business from my Kenosha County house?

Can I hire employees who don't live in my house?
Only if you run a professional office; Section 12.21.010(h) allows one nonresident employee for professional offices such as an accountant or attorney, but all other home occupations may use residents of the dwelling only.
