D. Home Occupations 1. General The home occupation regulations of this section are intended to permit residents to engage in home occupations while ensuring that home occupations will not be a detriment to the character and livability of the surrounding area. The regulations require that home occupations remain subordinate to the allowed principal use and that the residential viability of the dwelling unit and property is maintained. Home Occupations shall require Site Plan review.
Full Breakdown
D sets performance standards rather than a list of approved home businesses: any use complying with the standards is allowed unless specifically prohibited. 1 requires Site Plan review before operating. 2 when every listed condition is met: client and customer visits capped at 10 per week, no nonresident employees visiting the site, no outdoor activity or storage, and no hazardous materials stored beyond normal household quantities. 3, which can be conducted in either the principal dwelling or a permitted accessory dwelling. Table 6-4, the Summary of Home Occupation Regulations, differentiates Urban from Rural Zone Districts: Urban districts allow no nonresident employees while Rural districts allow up to two; both cap outdoor activity area at 25% of the dwelling unit's attached or detached structure (Rural adds 1,000 additional square feet); signage is capped at 2 square feet; and no change to the dwelling can make it appear less residential or visible as a home occupation from the road or adjoining properties.
f bars any odor, vibration, noise, dust, electrical interference or voltage fluctuation perceptible beyond the lot line, and requires businesses generating hazardous waste to register with the Mesa County Hazardous Waste Collection Facility's Conditionally Exempt Small Quantity Generators program.
Violations & Fines
Operating a home occupation without the required Site Plan review, or exceeding the outdoor-activity area, employee count, or 2-square-foot sign cap in Table 6-4, is a zoning violation Mesa County Code Compliance can cite; producing noise, odor, dust or electrical interference perceptible beyond the lot line under Section 6.04.D.3.f is independently enforceable regardless of whether the underlying use is otherwise compliant.
