Yolo County Zoning Code Sec. 8-2.306(ab) governs rural home occupations in agricultural zones (max two non-family employees, may use a detached shop, no external evidence of the business). Sec. 8-2.506 governs residential home occupations and limits the activity to the family, with no employees outside the household and no more than 50% of one floor of the dwelling.
RURAL HOME OCCUPATIONS (Sec. 8-2.306(ab), allowed by right in the A-N, A-X, and A-R zones per Table 8-2.304(e)): the activity must be 'clearly incidental and secondary to the residential and/or agricultural use of the dwelling or premises,' be confined within the dwelling and occupy not more than fifty percent (50%) of the gross area of one floor or be confined within a detached accessory structure such as a private shop or office, be operated by members of the family occupying the dwelling plus a maximum of two additional employees, produce no external evidence of its existence (goods, materials, and vehicles must be stored in enclosed structures), generate no dust, odors, noise, or other nuisances beyond what is normal for the area, not exceed normal truck/passenger/pedestrian traffic for the surrounding rural area or interfere with vehicle circulation, and meet the requirements of the Chief Building Official and the fire district. RESIDENTIAL HOME OCCUPATIONS (Sec. 8-2.506, allowed by right in residential zones): must be clearly incidental and secondary to the residential use, confined completely within the dwelling and occupying not more than 50% of the gross area of one floor, operated only by members of the family occupying the dwelling (no outside employees), produce no external evidence of the business, generate no traffic beyond normal neighborhood levels, require no additions or extensions to the dwelling, and meet Building and Fire Code requirements. Home occupations are NOT allowed in the A-C (Agricultural Commercial) or A-I (Agricultural Industrial) zones (Table 8-2.304(e)).
A home occupation that exceeds these performance standards is a zoning violation. Code Enforcement (within the Planning Division) issues notices of violation and can pursue administrative citations, civil injunctive relief, and nuisance abatement. Under California Government Code Section 25132 administrative infraction fines are capped at $100 for a first offense, $200 for a second offense within one year, and $500 for each additional offense within one year, with each day a separate violation. The County may also revoke any business license issued for an out-of-compliance home occupation.
