Aurora, Illinois levies a 6% hotel occupancy tax on room rentals, or a flat $10 per night if no cash charge is made, collected by the owner from the guest.

A tax is hereby levied and imposed upon the use and privilege of renting, leasing or letting a hotel room within the city at a rate of six (6) percent of the room rental rate (not including taxes or other nonroom rental charges added to the hotel bill) for each such hotel room rented for every twenty-four-hour period or any fraction thereof. In the event that no cash charge is levied for the occupancy of the room, a flat tax of $10 per night shall be imposed on the rentor or the person who is granted the privilege of occupying the hotel room. Incidence of tax. The ultimate incidence of and liability for payment of the tax is to be borne by the person who seeks the privilege of occupying the hotel room, such person hereinafter referred to as rentor. Payment of tax. The tax herein levied shall be paid in addition to any and all other taxes and charges. It shall be the duty of the owner of every hotel to secure the tax from the rentor of the hotel room and to pay the tax over to the treasurer under the procedures prescribed by the treasurer, or as otherwise provided in this article. Collection. Every person required to collect the tax levied by this article shall secure the tax from the rentor at the time he collects the rental payment for the hotel room. The amount due under the tax provided in this article shall be stated separately upon the invoice, receipt or other statement or memorandum given to the rentor at the time of payment. (Ord. No. O87-5754, § 1, 12-29-87)

Full Breakdown

Under Aurora Code of Ordinances § 44-192, the city imposes a 6% tax on the rental rate of any hotel or motel room within Aurora city limits (in Kane, DuPage, Will, or Kendall County), charged per 24-hour period. If no cash charge is levied, a flat $10-per-night tax applies instead. The guest (rentor) ultimately bears the tax, but the hotel owner must collect it at time of payment and remit it monthly to the city treasurer under § 44-195. Owners must also register for a certificate of registration under § 44-193 within 30 days of starting business. Up to 90% of proceeds are paid to the Aurora Area Convention and Visitors' Bureau under § 44-198. The tax applies citywide regardless of which of Aurora's four counties the property sits in.

Violations & Fines

Failure to collect, report, or remit the tax draws penalty plus interest under § 44-195(d) and can trigger license suspension or revocation under § 44-196; unpaid tax remains separately collectible by the city.

Frequently Asked Questions

Does Aurora's hotel tax apply to short lease residents?
No. Under § 44-199, permanent residents with a written lease of one month or more are exempt if they occupy the room the full reporting period and don't sublease it.
Who actually pays Aurora's hotel occupancy tax?
The guest renting the room bears the tax, but under § 44-192 the hotel owner must collect it at payment and remit it to the city treasurer.
