Summary

Gwinnett County levies an 8 percent excise tax on hotel, motel and short-term rental charges under code section 94-26, paid by the occupant to the operator or marketplace facilitator. The code's definition of "hotel" in section 94-23 expressly includes short-term rentals, so a homeowner renting on Airbnb or similar platforms owes the same 8 percent tax as a hotel guest.

These county ordinances apply to unincorporated areas of Gwinnett County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Pursuant to O.C.G.A. § 48-13-51, there is hereby levied and assessed and there shall be paid an excise tax of eight percent of the charge for the furnishing for value to the public of any room or rooms, lodgings, or accommodations furnished or facilitated by any operator or marketplace facilitator. Hotel means any hotel, motel, inn, lodge, tourist camp, tourist cabin, campground, short-term rental or any other place in which rooms, lodgings, or accommodations are regularly furnished for value and shall apply to the furnishing for value of any room, lodging, or accommodation.

Full Breakdown

Section 94-26 imposes the tax at eight percent of the charge for furnishing any room, lodging or accommodation for value, tracking the authority granted by O.C.G.A. § 48-13-51. Section 94-23 defines "hotel" broadly, covering hotels, motels, inns, lodges, tourist camps, tourist cabins, campgrounds and short-term rentals, so the tax reaches Airbnb-style bookings, not just traditional lodging. Under section 94-27, the occupant owes the tax and pays it to the operator or marketplace facilitator collecting the rent, and section 94-31 requires every operator or marketplace facilitator to register with the county's licensing and revenue manager before doing business and to display the resulting certificate of authority where guests can see it.

Operators remit monthly: section 94-32 sets returns and payment due on the twentieth day of the month following each monthly period, and rewards timely filers with a three percent collection fee deducted from the amount remitted, but only if the payment is not delinquent. Section 94-30 exempts charges for rooms furnished free of charge, government officials or employees traveling on official business, guests displaced by a fire or casualty, and any charges for continuous occupancy beyond the first 30 days. Section 94-25 restricts how the county can spend the proceeds: they must benefit county citizens, are tracked in a separate account by the director of financial services, and can only be disbursed on a vote of the board of commissioners.

Violations & Fines

Section 94-35 penalizes a late or incomplete payment at five percent or $5.00, whichever is greater, for the first 30 days late, with an added five percent or $5.00 for each additional 30-day period, capped at 25 percent or $25.00 total, plus interest at the prime rate plus three percent under O.C.G.A. § 48-2-40. Section 94-36 adds a 50 percent penalty for fraud or willful intent to evade the tax, and section 94-37 makes any violation of the article punishable by a fine of up to $500.00, imprisonment up to 30 days, or both.

Frequently Asked Questions

What is Gwinnett County's hotel/motel tax rate?
Eight percent of the charge for the room, lodging or accommodation, under section 94-26, levied under the authority of O.C.G.A. § 48-13-51. The occupant pays it to the operator or marketplace facilitator at the time of paying rent.
Does the tax apply to Airbnb and other short-term rentals?
Yes. Section 94-23 defines "hotel" to expressly include short-term rentals along with hotels, motels, inns, lodges, tourist camps and campgrounds, so a short-term rental host collects and remits the same 8 percent tax as a hotel.
Are any stays exempt from the Gwinnett hotel tax?
Yes. Section 94-30 exempts rooms furnished without charge, state or local government officials and employees traveling on official business, guests displaced by a fire or other casualty, and any charges for continuous occupancy beyond the first 30 days.
What happens if an operator pays the tax late?
Section 94-35 adds a penalty of five percent or $5.00, whichever is greater, for the first 30 days late, plus another five percent or $5.00 for each additional 30-day period, capped at 25 percent or $25.00, on top of interest at the prime rate plus three percent.
