Gwinnett County, GA Noise Ordinances: Construction Hours (2026)

Sec. 38-47(6) sets Gwinnett County's construction noise clock. On weekdays, construction noise plainly audible 300 feet or more from the property line is barred outside 7:00 a.m. to 9:00 p.m. On Saturdays the window shrinks to 9:00 a.m. to 6:00 p.m. Construction noise is banned outright on Sundays and on six federally recognized holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving, and Christmas Day, regardless of what day of the week they fall on.

Contractors facing a genuine scheduling crunch aren't entirely stuck: Sec. 38-47(6)c lets the Director of the Department of Planning and Development, or a designee, grant a special-hours permit of up to 14 days when the loss or inconvenience to a party in interest warrants it, and the Director can issue multiple such permits to the same applicant if the need continues. Sec. 38-47(6)d carves out a blanket exception for government road, water, sewer, and stormwater construction or maintenance projects, and for utility company construction or maintenance work, none of which is bound by the standard hours or the permit process.

The 300-foot "plainly audible" test is the same standard used across Article III: it doesn't require a decibel meter, just that a person of ordinary hearing can hear the noise at or beyond that distance from the property line. Because construction is carved out under its own specific-restrictions subsection, it isn't measured against the general catch-all table in Sec. 38-48, which explicitly excludes sounds already regulated under Sec. 38-47.
