Under Texas Property Code and common law, a neighbor may bring a nuisance suit if bamboo roots damage their property, invade their land, or damage structures or utilities. Clumping bamboo varieties are generally non-invasive and present no legal issues. Property owners planting running bamboo should install a root barrier (at least 24-30 inches deep) to contain spread.
