Edison Township does not mandate native-plant landscaping but operates within the framework of the New Jersey Native Plants Initiative (P.L.2019, c.31, enacted from HB 1456). The Initiative requires State entities and any landscaping projects on State-funded property to use predominantly native plants. Edison's site-plan and stormwater-management requirements incentivize native plantings as part of post-construction stormwater controls under N.J.A.C. 7:8.
Edison Township does not impose a residential native-plant mandate. New Jersey adopted the Native Plants Initiative through P.L.2019, c.31 (signed June 6, 2019, originally HB 1456), which requires the State to give a preference to native plants in landscaping projects on State-owned property and in projects funded with State money or carried out by State entities. The Initiative is administered through the Department of Environmental Protection and the State Forester. It does not mandate native landscaping on private residential property. However, Edison's site-plan approval process under Chapter 37 (Zoning) and the New Jersey Stormwater Management Rules (N.J.A.C. 7:8) incentivize native plantings in post-construction stormwater best-management practices: rain gardens, bioretention basins, and bioswales installed under N.J.A.C. 7:8-5 are typically planted with native or non-invasive species per the NJ Stormwater BMP Manual. The Jersey-Friendly Yards program (Brick-based, statewide partner of NJDEP) provides free design guidance for homeowners converting to native plantings. Edison's parks system has begun incorporating native meadow restoration in selected open-space parcels.
Edison does not impose penalties on homeowners for non-native landscaping. NJDEP enforcement of the State Native Plants Initiative applies only to State landscaping projects and falls within standard State contracting compliance. Failure to install required native-plant stormwater BMPs on an approved site plan can trigger a stop-work order, withhold of the Certificate of Occupancy, and standard Chapter 37 zoning enforcement under Chapter 1 Β§1-5 ($100β$2,000 per violation).
