Florida law encourages rainwater harvesting and Miami-Dade County does not prohibit residential rain barrel use. Florida Statute 373.62 prevents local governments from banning rainwater harvesting systems. No permit is needed for standard rain barrels on residential property.
Florida Statute 373.62 (effective 2019) explicitly prohibits counties and municipalities from adopting ordinances that ban rain barrels or rainwater harvesting systems on residential property. Miami-Dade County allows residential rain barrels without permits. Rain barrels must be properly screened to prevent mosquito breeding β a significant concern in South Florida's tropical climate. The South Florida Water Management District (SFWMD) encourages rainwater collection as part of water conservation. Larger cistern systems may require building permits. Rain barrels should not create standing water accessible to mosquitoes; the county's mosquito control program enforces standing water violations. Collected rainwater may be used for irrigation but is not approved for potable use without treatment.
No penalties for using rain barrels. However, uncovered rain barrels that breed mosquitoes violate standing water ordinances. Miami-Dade Mosquito Control can issue citations for containers breeding mosquitoes. Keep barrels screened and sealed.
