Arizona HB 2675 (2012) prohibits HOAs and municipalities from banning residential rainwater harvesting. No permit needed for systems under 5,000 gallons.
Arizona House Bill 2675, signed into law in 2012, explicitly prohibits cities, towns, and homeowners associations from adopting rules that ban the installation of rainwater harvesting systems on residential property. This means Oro Valley cannot prohibit residents from collecting rainwater. The Town actively encourages rainwater harvesting as a supplemental irrigation source for desert-adapted landscaping, which reduces demand on the Oro Valley Water Utility and the regional groundwater supply. Residential systems typically use above-ground cisterns or below-grade tanks connected to roof downspouts and gutters. Arizona does not require a permit for residential rainwater collection tanks under 5,000 gallons, though larger systems or those connected to plumbing may need a building permit and must comply with the Uniform Plumbing Code. The Town encourages passive rainwater harvesting through landscape grading that directs stormwater to planted basins and swales. Pima County offers periodic workshops and rebates for rainwater harvesting system installation. An average Oro Valley roof can capture approximately 600 gallons per inch of rainfall, which is significant given the 11-12 inches of annual precipitation concentrated during monsoon season.
No penalties for harvesting rainwater. Under HB 2675, any HOA or municipal restriction on residential rainwater harvesting systems is unenforceable. Building permits may be required for systems over 5,000 gallons or those connected to household plumbing.
