Routine pruning of an ordinary tree on private property in Lake Forest does not require a City permit. The major exception is eucalyptus. Under Municipal Code Chapter 6.20 (Regulations Pertaining to Conversion, Maintenance and Removal of Eucalyptus Trees), it is unlawful during the restricted period of April 1st through October 31st each year to prune, cut branches from, top, or cut down any eucalyptus tree, or to transport eucalyptus logs, branches, or trunks on City streets, unless a eucalyptus tree cutting permit has been obtained. The rule exists to control the eucalyptus longhorn borer beetle. Any cutting or pruning under a permit must follow generally accepted arboricultural practice or be supervised by a qualified arborist. For parkway (street) trees, the abutting property owner is responsible for maintenance under Streets and Highways Code Section 5610, but in practice the City's Public Works Maintenance Division performs pruning of publicly owned and parkway trees, with City tree pruning typically taking place November through March (outside the eucalyptus restricted period). Trees and vegetation must also be kept clear of the right-of-way, maintaining 14 feet of clearance over roadways and 7 feet over sidewalks (Chapter 6.12).
Pruning or topping a eucalyptus tree during the April 1-October 31 restricted period without a permit violates Chapter 6.20 and is enforceable as a municipal code violation. The Director may also impose permit conditions, including requiring that cut eucalyptus wood be chipped, burned, buried, or tarped immediately to prevent borer spread.
