Lake Forest is one of the Orange County cities that adopts hard decibel numbers rather than a vague 'plainly audible' standard. Section 11.16.030 designates the whole city as 'Noise Zone 1.' Section 11.16.040 then sets residential exterior limits of 55 dBA (7:00 a.m.-10:00 p.m.) and 50 dBA (10:00 p.m.-7:00 a.m.), measured at any point on the affected property using an A-weighted meter at slow response (Section 11.16.025). For music, speech, impact or simple-tone noise, each limit is reduced by 5 dBA. The code is not a single flat number; it uses a duration-versus-level table. It is unlawful to exceed the noise standard for more than 30 minutes per hour; the standard plus 5 dBA for more than 15 minutes; plus 10 dBA for more than 5 minutes; plus 15 dBA for more than 1 minute; or plus 20 dBA for any period at all. Section 11.16.050 adds interior standards of 55 dBA daytime and 45 dBA at night, with tighter duration tiers. Where the ambient (background) noise already exceeds a limit, the allowable level is raised to the ambient level. Section 11.16.070 extends the Section 11.16.040 limits to schools, hospitals and churches when conspicuous signs are posted. A variance from these numbers may be sought from the Noise Variance Board under Section 11.16.100 for a $75 fee.
Exceeding the Section 11.16.040 or 11.16.050 decibel standards (including the duration tiers and the 5 dBA music/speech reduction) is a noise violation. Under Lake Forest Municipal Code Sections 1.01.200-1.01.260 it is a misdemeanor punishable by up to $1,000 and/or six months in county jail, and may be prosecuted as an infraction at the City Attorney's discretion.
