Operators who need to exceed the limits can seek a variance from the Noise Variance Board (Section 11.16.100), which carries a $75 application fee.
Amplified music that pushes a neighboring residential property above the Chapter 11.16 limits (including the 5 dBA music reduction) is a noise violation. Under Sections 1.01.200-1.01.260 it is a misdemeanor punishable by up to $1,000 and/or six months in jail, prosecutable as an infraction. Police may issue a warning before citing.
