Tomball requires property owners to maintain trees so they do not obstruct public sidewalks, streets, or visibility at intersections. Trees overhanging sidewalks must provide at least 8 feet of vertical clearance, and those overhanging streets must provide at least 14 feet. The city may trim or remove hazardous trees at the owner's expense if the owner fails to act after notice.
Under Tomball's Code of Ordinances, property owners are responsible for trimming trees and vegetation that encroach on public rights-of-way. Trees and shrubs adjacent to sidewalks must be trimmed to maintain a minimum vertical clearance of 8 feet. Trees adjacent to streets must provide at least 14 feet of clearance for vehicle traffic. Vegetation must not obstruct traffic signs, signals, or sight lines at intersections. The city's public works department or code enforcement may issue notice requiring trimming within a specified period, typically 10 days. If the property owner fails to trim after proper notice, the city reserves the right to perform the work and assess costs to the property owner. Dead, diseased, or hazardous trees that pose a danger to public safety or adjacent properties may require immediate removal. Tomball does not have a heritage tree ordinance or require permits for trimming trees on private property. However, trees in public rights-of-way or on city property cannot be trimmed or removed without city authorization.
Failure to trim after notice may result in the city performing the work at the owner's expense. General code violations carry fines up to $500 per offense. Damage to city-owned trees may result in liability for replacement costs based on the tree's appraised value.
