Lane Code 9.057.574 defines weeds more than ten inches high as "noxious vegetation," along with poison oak or ivy, tansy ragwort, thistle, and encroaching blackberry. In UGBs and RR/RA-zoned areas, owners may not permit noxious vegetation on their property.
Under Lane Code 9.057.574, "Noxious Vegetation" includes weeds more than ten inches high; grass more than ten inches high; poison oak or poison ivy; tansy ragwort; blackberry bushes that extend into a public thoroughfare or across a property line; and thistle. LC 9.057.576(C) makes noxious vegetation on public or private property a nuisance in areas within city urban growth boundaries, or developed/committed areas designated Community or zoned RR-5, RR-2, RR-1 or RA in the 1987 Rural Comprehensive Plan. No owner or person in charge may allow it to be on the property or encroach into the abutting right-of-way. The county's road vegetation program also targets these species in road clear zones.
Class 1 failure to comply under LC Chapter 5; after 10 days' notice the County may abate the nuisance and place a lien for the costs plus an administrative fee.
