The statewide enabling law lets a municipality require owners or tenants to destroy weeds (including ragweed), brush, dead and dying trees, stumps and obnoxious growths where needed for public health, safety, welfare or fire prevention. Owners typically receive written notice and about 10 days to comply; if they don't, the town removes the growth and bills the owner, filing a lien if unpaid (N.J.S.A. 40:48-2.14). Passaic County does not enforce these rules on private property — they live in each municipal property-maintenance or brush-and-weeds chapter, so look up your specific borough, township or city code.
