Colorado's Noxious Weed Act requires all landowners to control noxious weeds. Douglas County enforces the Act on unincorporated land; Castle Rock adds a 12-inch weed-height limit. List A and B weeds must be eradicated or contained by state law.
Under the Colorado Noxious Weed Act (C.R.S. Article 35-5.5), every public and private landowner has a legal duty to manage state-designated noxious weeds so they do not damage neighboring land. List A species require mandatory eradication; List B require eradication or containment; List C are locally decided. Douglas County's weed program inspects, notifies owners, and can abate uncontrolled infestations, billing the property. Separately, Castle Rock's Municipal Code (Ch. 8.12) caps weed and grass height at 12 inches for fire prevention. The two rules overlap: keep noxious weeds controlled year-round and general growth under 12 inches within town.
After written notice, the county or town may enter, abate the weeds, and assess the cost against the property as a lien.
