Summary

On county-controlled property, Union County bars leaving a bicycle where it blocks a sidewalk or path, requires cyclists to use a marked bicycle path once one exists rather than the roadway, and limits roadway riders to two abreast in the direction of traffic.

These county ordinances apply to unincorporated areas of Union County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No operator of a bicycle shall leave a bicycle laying, or standing upon any sidewalk, footpath, footbridge, roadway, bridle path or any other public land or in any building owned by the County of Union which land is commonly used for pedestrian or vehicular traffic, in such a manner as to hinder or impede pedestrian or vehicular traffic. ... No person shall operate a bicycle on a roadway, except as a thoroughfare, and no person shall operate a bicycle upon any sidewalk, footpath, footbridge, or bridle path, except those that are specifically set aside and marked for bicycle use. No person shall operate a bicycle in such a manner as to impede vehicular traffic. ... Every person operating a bicycle on a roadway shall ride in the direction of traffic flow as near to the side of the roadway as practicable and persons riding bicycles upon a roadway shall ride no more than two abreast. When a usable path for bicycles has been provided, bicyclists shall use such path and shall not use the roadway.

Full Breakdown

Laws of Union County § 115-14 sets bicycle operating rules for property the county owns, leases, or controls. Subsection F bars leaving a bicycle lying or standing on a sidewalk, footpath, footbridge, roadway, bridle path, or other county land used for pedestrian or vehicular traffic in a way that hinders or impedes that traffic; this is the county's obstruction rule and it applies to any public land under county control, not just designated bike paths. Subsection G confines bicycles to a roadway used only as a thoroughfare, or to a sidewalk, footpath, footbridge, or bridle path that has been specifically set aside and marked for bicycle use, and separately bars riding in a manner that impedes vehicular traffic.

Subsection H builds on that: a cyclist on a roadway must ride in the direction of traffic flow, as near to the side as practicable, and no more than two abreast; once the county has provided a usable bicycle path, cyclists must use that path and may not use the roadway instead. The County Manager, acting through the Director of the Department of Public Safety, can adopt further rules for safe bicycle operation under subsection I, provided they do not conflict with any ordinance or state law, and those rules must be posted conspicuously.

Bicycles operated on county property must also be registered with the rider's home municipality under subsection A, and an unregistered or improperly marked bicycle is subject to inspection and possible impoundment by Union County Police under subsections C and D.

Violations & Fines

Riding in a way that hinders pedestrian or vehicular traffic, or riding on a roadway when a marked bicycle path is available, has no fine written into § 115-14 itself, so the Public Safety Code's general penalty at § 115-2.F applies: $25 to $200 per violation. A bicycle with an altered, mutilated, or destroyed serial number, or one that fails registration or safety inspection, can be impounded by Union County Police under § 115-14.D, with storage costs charged to the owner.
