Virginia Beach's signature 28-foot-wide concrete bike path runs alongside the Atlantic Avenue boardwalk and is governed by City Code Chapter 21 rules requiring single-file riding, 10 mph speed in congested zones, and yielding to pedestrians at all crossings.
The bike path along the Atlantic Avenue oceanfront is a separate facility from the wooden boardwalk and is the lawful place for bicycles, e-bikes Class 1 and 2, and shared scooters in the Resort Area. Riders must keep right, ride single file when overtaking, and slow to pedestrian pace at street crossings between 1st and 40th Street. Class 3 e-bikes (28 mph capability) are prohibited on the bike path. Off the resort, bicycles may use any street and have the same rights and duties as vehicles under Va. Code Section 46.2-800. The Cape Henry Trail in First Landing State Park has separate park rules.
Civil penalty $25-$100 for boardwalk riding, failure to yield, or wrong-way operation. Class 4 misdemeanor possible for repeat or reckless violations.
