Fulton County, GA Mobility & Curb Rules: Red-Light Cameras (2026)

Article V of the county code, adopted by Resolution No. 05-0692 on June 1, 2005, authorizes "traffic-control signal monitoring devices" under O.C.G.A. § 40-14-21 and ties enforcement to O.C.G.A. §§ 40-6-20, 40-14-21 through 40-14-24. The Fulton County Police Department, not the courts or a private vendor, both picks which intersections get cameras (in compliance with O.C.G.A. §§ 40-14-22 and 40-14-23) and administers the whole enforcement program under O.C.G.A. § 40-6-20. A violation requires recorded images, defined as two or more photographs, microphotographs, electronic images, or videotape, that show a vehicle running a circular red or red-arrow signal AND clearly reveal the license plate.

The civil penalty is capped at $70.00 per citation, issued by FCPD under O.C.G.A. § 40-6-20(f)(3)(B). Liability is decided on a preponderance-of-the-evidence standard, and a citation creates a rebuttable presumption that the registered owner was driving. An owner can rebut that presumption three ways: testifying under oath in open court that they weren't driving, filing a certified police report showing the car was reported stolen before the violation, or submitting a sworn notarized statement identifying who was actually driving. The article does not bar police from using other evidence to prosecute a straight red-light violation under O.C.G.A. § 40-6-20(a) instead of, but never in addition to, a camera citation.

Every time a new device is installed, the county must send only warning notices, no citations, for the first 30 days. Because this article is a Fulton County ordinance enforced by the county's own police department at intersections FCPD itself selects, it reaches only roadways under the county's own traffic-enforcement authority; it does not create or govern any camera program inside Atlanta, Sandy Springs, Johns Creek, Milton, or Fulton's other incorporated cities, which set their own photo-enforcement policies independently.
