Bowie, MD Noise from Specific Sources: Bar & Nightclub Noise (2026)

Added by Ordinance No. O-1-23 on February 6, 2023, § 13-5 targets commercial establishments, including bars and nightclubs, that sit near residential property. The section reaches noise from 'any outdoor area that is part of or under the control of the establishment,' so a rooftop bar, beer garden or patio speaker system is covered the same as indoor sound leaking through walls. The restricted window runs 9:00 p.m. to 7:00 a.m., and the standard is 'unreasonable adverse effects on adjacent or nearby residents' rather than a fixed decibel reading, though § 13-5 also folds in the loud-or-raucous-noise list from § 13-3A and the plainly-audible decibel standard from § 13-2A, so amplified music, yelling patrons or loudspeaker advertising can each independently violate the section.

The section separately declares the noise of garbage, trash, solid waste and recycling collection by commercial property owners and operators to be an unreasonably loud and unnecessary noise if it happens in that same nighttime window, reaching dumpster pickups timed for early morning. Penalties are steeper than the general chapter fine: § 13-6A(3) sets $750 for a first violation and $1,000 for each subsequent one, and § 13-6B makes every day a violation occurs, not just every hour, a separate offense. Enforcement runs through Bowie Code Compliance and the Bowie Police Department as a municipal infraction under Chapter 1, § 1-6's citation procedure.
