Full Breakdown
The Town of Irondequoit Code has no noise section aimed at bars or nightclubs as a class. Its venue-specific noise rule, § 235-76.16, applies to adult use and entertainment establishments, the licensed category that includes adult cabarets, which can sell alcohol lawfully under the Alcoholic Beverage Control Law (§ 235-76.14).
Subsection A makes it unlawful for the licensee, owner, proprietor, manager or person in charge to permit entertainment amplified by a mechanical device of such an intensity, character and duration as to disturb the peace, tranquillity and good order of the people of the Town of Irondequoit, or that otherwise violates the zoning chapter and Chapter 160, Noise. Subsection B sets a physical standard: the premises must be soundproofed, or provision made so that no amplification or excessive noise is audible beyond the property lines of the parcel.
Management duties reach past the walls. Section 235-76.17 makes it unlawful to permit disorderly, noisy, riotous or tumultuous conduct or loitering on the premises. It also bars any noise, disturbance, misconduct or activity in the premises, in the area in front of or adjacent to them, or in any parking lot the licensee provides, that in the judgment of the Town Board adversely affects the health, welfare, safety or repose of inhabitants or makes the premises a focal point for police attention. Outside doors must stay closed during hours of operation except for entry and exit, unless the Police Department orders otherwise (§ 235-76.19A). Before a license issues, the Chief of Police's investigation includes the present and projected noise, traffic and public safety impacts (§ 235-76.5A).
Every other bar, restaurant or club in the Town of Irondequoit falls under Chapter 160. Under § 160-6, sound from an amplifying device is prima facie evidence of a violation if audible beyond the property line between 10:00 p.m. and 8:00 a.m., or audible at 50 feet beyond the property line between 8:00 a.m. and 10:00 p.m. Section 160-4 bars any excessive noise, and the Chief of Police administers the chapter.
Violations & Fines
Under § 235-76.24, a violation of the adult use article is a Class A violation under § 1-16: a fine not less than $250 nor more than $500 or not more than 15 days' imprisonment, or both, plus costs of restoration. The Town Board can also suspend or revoke the license under § 235-76.7. Chapter 160 violations are Class B violations: a fine of $100 to $250 or up to 15 days, or both, with injunctions available under § 160-19.
