Moore County, NC Noise from Specific Sources: Bar & Nightclub Noise (2026)

Moore County Code § 10-41 makes it unlawful to willfully make or continue any "loud, raucous, disturbing or unnecessary noise" that annoys, disturbs, injures or endangers the comfort, health, peace or safety of reasonable persons within the county, and the section separately flags playing a radio, phonograph, CD player or performing band at a volume that disturbs a nearby dwelling, hotel or motel under subsection (b)(3). Section 10-42, however, lists 18 exempt categories, including at (10) industrial enterprises and at (11) "noises resulting from the normal operations of any commercial enterprise," language that covers a bar or nightclub's ordinary music, PA systems and crowd noise during business hours.

Section 10-43 puts the burden on whoever claims the exemption to prove it applies, so a venue cited for noise must show the sound was part of normal operations rather than, for example, amplified music used to attract attention to a show under subsection (b)(5), which itself requires a sheriff-issued permit. An operator who wants certainty for an outdoor event can instead apply under Sec. 00 fee.
