Summary

Jefferson Parish zoning sets exact placement rules for air conditioning units, generators and other mechanical equipment on single- and two- to four-family lots. The equipment cannot sit in the front yard at all, needs specific side-yard clearances from the property line, and roof-mounted units are capped by the base district's height limit.

These county ordinances apply to unincorporated areas of Jefferson Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(a)Setback requirements. Generators, pool equipment, air conditioning units, and other types of mechanical equipment:(1)Front yard. Shall not be located in the required front yard.(2)Side yard. May be located in the required side yard, provided that:a.Generators shall be set back at least five (5) feet from any side property line. For corner lots, generators shall be located at least five (5) feet from the property line abutting the side street and shall not obstruct any clear vision area.b.Any other type of mechanical equipment shall be set back at least two (2) feet from any side property line, provided that at least one (1) side yard area shall maintain at least five (5) feet of unobstructed access from the nearest side lot line and the mechanical equipment shall not obstruct any clear vision area.(3)Rear yard. May be located in the required rear yard at least three (3) feet from the property lines provided that the mechanical equipment shall not obstruct any clear vision area.(b)Roof-mounted mechanical equipment.(1)Mechanical equipment installed on a roof shall not exceed the maximum building height permitted in the base zoning district.

Full Breakdown

2 of the Comprehensive Zoning Ordinance governs where generators, pool equipment, air conditioning units and similar mechanical equipment may sit on residential lots. The front yard is off-limits entirely: no mechanical equipment of any kind may be located there. In the side yard, a generator must sit at least five feet from the side property line, and on a corner lot at least five feet from the line abutting the side street, without blocking the clear vision area drivers need at the corner. Other mechanical equipment, including AC condensers, needs only a two-foot side setback, but at least one side yard on the lot must keep five feet of unobstructed access along the property line, again without obstructing the corner's clear vision triangle.

In the rear yard, equipment may sit as close as three feet to the property line, provided it still does not block the clear vision area. 1. Anyone who cannot meet these setbacks must seek a variance from the Board of Zoning Adjustments or, in some cases, the parish council; the code specifically bars granting a zoning variance for a generator that does not otherwise meet applicable technical codes unless the Board of Standards and Appeals has separately approved a variance from those codes. The rule reaches every type of noise-generating mechanical equipment homeowners install close to a shared lot line, not just central air condensers, and applies parish-wide in the unincorporated areas Jefferson Parish zones directly.

Violations & Fines

Placing a generator, condenser or other mechanical equipment in the front yard, or closer to a side or rear property line than these setbacks allow, is a zoning code violation subject to the parish's general penalty under Section 1-10: a fine of up to $1,000, up to six months imprisonment, or both, with each day the violation continues counted as a separate offense. Code enforcement or the permitting office can require relocation before signing off on a permit.

Frequently Asked Questions

Can I put my central AC unit in my front yard in Jefferson Parish?
No. Section 33-6.9.2.2 bars generators, pool equipment, air conditioning units and other mechanical equipment from the required front yard entirely, regardless of lot size or screening.
How close can a generator sit to my neighbor's side property line?
At least five feet. Corner-lot generators also need five feet from the line abutting the side street and cannot block the corner's clear vision area, per Section 33-6.9.2.2(a)(2)a.
Is there a height limit for a rooftop AC unit?
Yes. Roof-mounted mechanical equipment cannot exceed the maximum building height allowed in the base zoning district, and units in the Old Metairie Neighborhood Conservation District must also be screened.
