Section Seven(D) of Ord. 14-18 states the noise ordinance does not apply to 'noise created by the operation of all Lee County Airports.' Aircraft operations and flight-path noise are governed by federal law (the FAA under 49 U.S.C. and 14 CFR), which preempts local regulation of aircraft in flight. Southwest Florida International Airport (RSW) and Page Field are operated by the Lee County Port Authority, which runs the noise-abatement and complaint program. Ground activity unrelated to airport operation may still fall under the general ordinance, but airport and aircraft noise itself does not.
No county penalty applies to exempt airport/aircraft noise. Airport noise concerns are handled administratively by the Lee County Port Authority's noise program.
