Cape Coral, FL Noise Ordinances: Aircraft Noise (2026)

" Given Cape Coral's canal-laced layout, the waterway exception matters in practice: a helicopter operating over a canal that separates it from the nearest home falls outside the ban, but one hovering or landing within 500 feet of a residence with no right-of-way or waterway between them violates the section. The ordinance, adopted by Ord. 4-83 in January 1983 and amended by Ord. 31-83 that July, exempts public aircraft operated by the federal government, a state or political subdivision, or taxing districts such as Lee County Mosquito Control, under § 12-24(b)(1).

It also exempts emergency use of rotary wing aircraft serving city residents, and privately owned helicopters functioning as ambulances, search-and-rescue craft, or similar duty. Beyond those categorical exemptions, § 12-24(b)(2) lets the City Council grant temporary exemptions on a finding that doing so benefits public welfare, giving the city discretion to permit events like construction lifts or filming that would otherwise fall inside the 500-foot zone.
