City-specific rules exist: Cape Coral, and Fort Myers have their own aircraft noise rules that differ from Lee County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

The following will not be considered a violation of this ordinance:... Noise created by the operation of all Lee County Airports.

Full Breakdown

Section 19-152(4) lists noise created by the operation of all Lee County airports among the things that will not be considered a violation of the noise article, so the decibel limits in Section 19-151 do not reach it. The county handles airport noise on the land-use side. Section 34-1104 defines Airport Noise Zone B as the land within the 60 DNL contour line from the FAR Part 150 study in effect and bars new residential living units, places of worship, libraries, educational facilities, hospitals, correctional facilities and nursing homes there. Zone C runs out to the 55 DNL contour. Zones B, C and D require recorded disclosure.

Violations & Fines

Because airport operation noise is excepted, it is not citable under the noise article. Building a restricted use inside Airport Noise Zone B is a zoning violation instead, enforced through the Hearing Examiner.

Frequently Asked Questions
