Summary

New or redeveloped buildings in the Airport Overlay AO-4 Noise Zones Area, the airfield noise footprint around Scott Air Force Base and MidAmerica St. Louis Airport, fall into one of four noise zones under Zoning Code Sec. 40-4-128(C): NZ-1 (65-69 dB day-night level), NZ-2 (70-74 dB), NZ-3 (75-79 dB) and NZ-4 (over 80 dB, federal land only). Each zone carries its own attenuation and land-use limits.

These county ordinances apply to unincorporated areas of St. Clair County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

40-4-128 PURPOSE AND GENERALLY. (A) The purpose of this section is to require that new or redeveloped buildings within the Noise Zones Area, Airport Overlay (AO-4) District, be constructed with materials and in such manner that aircraft noise is reduced by the structure to an interior level which has no adverse impact on the health, safety, and general welfare of the residents. ... (C) Establishment of Noise Zones. ... There are four (4) applicable noise zones: (a) NZ 1: Area within the noise zone where the DNL is between 65 and 69 dB. (b) NZ 2: Area within the noise zone where the DNL is between 70 and 74 dB. (c) NZ 3: Area within the noise zone where the DNL is between 75 and 79 dB. (d) NZ 4: Area within the noise zone where the DNL is greater than 80 dB.

Full Breakdown

Sec. 40-4-128 sets up four aircraft noise contour zones measured in day-night average sound level (DNL): NZ-1 runs 65 to 69 dB, NZ-2 runs 70 to 74 dB, NZ-3 runs 75 to 79 dB, and NZ-4 exceeds 80 dB, though NZ-4 is "only located on federally controlled land," meaning Scott AFB property rather than private parcels. Sec. 40-4-130 layers use and construction restrictions on top of the underlying zoning district for each zone: manufactured housing and outdoor amphitheaters are barred in every noise zone, and NZ-2 through NZ-4 additionally prohibit new residential uses, hotels and overnight lodging outright, with NZ-3 and NZ-4 also barring hospitals, nursing homes, child care centers, schools, theaters and churches.

Where a noise-sensitive building is still permitted, Sec. 40-4-130 requires sound attenuation reaching a 25 dB noise reduction level (NRL) in NZ-1 and a 30 dB NRL in NZ-2 through NZ-4 for offices, retail and industrial space, and 25-30 dB for hospitals, schools and similar uses depending on the zone. Sec. 40-4-131 spells out how that attenuation is achieved: plans must be certified by a recognized acoustical specialist, and buildings must use sealed, close-fitting doors and windows, capped chimneys, bent ventilation ducts, and caulked wall penetrations so no direct line of sight to the outdoors exists through any vent.

Existing homes are grandfathered for additions and repairs if the owner signs a waiver acknowledging the specifications were not applied. Development applications within the AO-4 District also require Air Force consultation under Sec. 40-4-115.

Violations & Fines

Building in an AO-4 Noise Zone without the required sound attenuation, or placing a prohibited use such as new residential construction in NZ-2 through NZ-4, is enforced as a Zoning Code violation under Sec. 40-11-10: a Class B misdemeanor with a fine of $50 to $500 plus costs, and each day of non-compliance is a separate offense. The Director may also issue a stop-work order under Sec. 40-4-113(C) until attenuation is corrected.

Frequently Asked Questions

What noise zone is my property in near Scott Air Force Base?
Sec. 40-4-128(C) maps four contour zones by day-night average sound level: NZ-1 at 65-69 dB, NZ-2 at 70-74 dB, NZ-3 at 75-79 dB, and NZ-4 above 80 dB. The boundaries follow the Air Installation Compatible Use Zone study and are shown on the Airport Overlay map referenced in Sec. 40-4-111.
Can I build a new house in one of the noise zones?
Not in NZ-2, NZ-3 or NZ-4: Sec. 40-4-130 prohibits new residential uses, including hotels and overnight lodging, in those zones outright. In NZ-1, single-family density is capped at one dwelling unit per acre and new construction must reach a 25 dB noise reduction level.
What construction is required to soundproof a building in a noise zone?
Sec. 40-4-131 requires airtight door and window seals, weather-stripping, capped chimneys, bent ventilation ducts with no direct line of sight to the outdoors, and caulked wall penetrations, all certified by a recognized acoustical specialist to hit the 25 or 30 dB noise reduction level Sec. 40-4-130 requires for that zone.
