(5)Airport noise zones.a.No new noise-sensitive land uses shall be established within the limits of the 65 L dn /DNL noise exposure contour as delineated in the most current 14 CFR part 150 Airport Noise Compatibility Study in effect at the time of a development proposal. Noise-sensitive land uses include, but are not limited to: single-family residential, multifamily residential, mobile homes, houses of worship, schools (with the exception of aviation schools), group homes, hospitals, day care centers and museums...b.Expansion, replacement or renovation (with a cost at least 60 percent of the existing assessed value) of an existing noise-sensitive use or structure within the 65 DNL noise exposure contour may be approved if:1.The work incorporates building techniques and materials that will result in a 25-decibel reduction between the exterior noise level and that inside the structure; or2.The owner/developer voluntarily provides a recorded avigation easement for noise with non-suit covenant running with the land in a format acceptable to the county.

Sec. 72-296(d)(5)a draws the line at the '65 Ldn/DNL noise exposure contour,' the day-night average sound level measurement defined in subsection (b)(9), as delineated in the most current 14 CFR Part 150 Airport Noise Compatibility Study for a given public-use airport. Inside that contour, no new noise-sensitive land use may be established, the section lists single-family and multifamily residential, mobile homes, houses of worship, schools other than aviation schools, group homes, hospitals, day care centers and museums as noise-sensitive, and incorporates the full 14 CFR Part 150 Appendix A compatibility table by reference.
An existing noise-sensitive use inside the contour can still expand, replace or renovate, if the work costs at least 60 percent of the structure's assessed value, but only by incorporating construction that cuts interior noise by 25 decibels compared to the exterior, or by the owner voluntarily recording an avigation easement with a non-suit covenant running with the land. Where a public airport hasn't completed a noise study, subsection (d)(5)c independently bans residential construction and most educational facilities within a distance equal to half the longest runway's length, measured from each runway centerline.
These rules apply to the seven public-use airports named in the section: Daytona Beach International, DeLand Municipal, New Smyrna Municipal, Ormond Beach Municipal, Pierson Municipal, Orlando-Sanford International, and Massey Ranch Airpark.

Establishing a prohibited noise-sensitive use inside a 65 DNL contour without qualifying construction or an avigation easement is enforced as an airport protection overlay violation, administered by the zoning enforcement official under the same Article II framework as other permit denials in Sec. 72-296(e), with noncompliance subject to the standard zoning penalties of Sec. 72-341(f): a fine up to $500 and/or 60 days in jail per day.
