Chapter 42, Article IV of the City Code sets Daytona Beach's noise standards, including the § 42-215 decibel table and the § 42-214 nighttime prohibitions, but § 42-213 lists sources the city commission has chosen to exempt outright. Subsection (5) states that aircraft in flight and airport-related flight-operation sounds are exempt from the article. curfew, or its enforcement under § 42-262, because aircraft-in-flight noise sits outside the article's reach. The exemption is narrow, though: the same subsection specifically excludes model aircraft, so remote-control planes, drones and similar devices remain fully subject to the general prohibitions in § 42-214 and the numeric limits in § 42-215, including the residential nighttime cap and the requirement that any complaint be measured at least 100 feet from the property line under § 42-216.

A resident disturbed by a hobbyist's drone or model plane, unlike one disturbed by airport traffic, can pursue a standard noise complaint through the city's code enforcement board.
