City Code Chapter 42, Article IV governs noise citywide, and § 42-213(2) carves out construction operations as an exempt source, but only while all equipment runs in accord with the manufacturer's specifications and with standard manufacturer mufflers or noise-reducing equipment in proper operating condition. The same subsection withdraws that protection specifically in residential areas: in residential areas the exemption does not apply during the hours from 10:00 p.m. to 7:00 a.m. That means a contractor running compliant, muffled equipment on a residential job site during the day is exempt from the noise article altogether, but the same equipment running between 10:00 p.m. and 7:00 a.m. in a residential area loses the exemption and falls under § 42-214's general ban on producing unreasonable noise that disturbs residents' peace and comfort, and under the § 42-215 numeric standards, which cap sound at 5 dBA above background noise (or 55 dBA under the residential nighttime fallback table) between 10:00 p.m. and 7:00 a.m.

Section 42-214(d) makes the property owner, tenant, contractor or any other person in lawful possession of the job site responsible for compliance regardless of who is actually running the equipment. Enforcement runs through § 42-262: a violation is punishable under § 1-14 of the City Code, and the code enforcement board has independent jurisdiction to hear violations under F.S. ch. 162.
