Port Orange, FL Noise Ordinances: Construction Hours (2026)

The city's noise article treats construction as a specifically prohibited noise source under Section 42-81(8) of the Code of Ordinances: operating tools or equipment for construction, drilling or demolition between 7:00 p.m. and 7:00 a.m. Monday through Saturday, or between 6:00 p.m. and 10:00 a.m. on Sundays, New Year's Day, Memorial Day, the Fourth of July, Labor Day, Thanksgiving Day and Christmas Day, is unlawful if it causes a noise disturbance across a residential property boundary or inside a noise-sensitive zone such as a hospital, school, or church.

Section 42-82(5) mirrors those hours as an affirmative exemption: construction under an issued building permit, or government work exempt from permitting, is allowed to begin no earlier than 7:00 a.m. and must end by 7:00 p.m. on weekdays and Saturdays, and is allowed to begin no earlier than 10:00 a.m. and must end by 6:00 p.m. on the same list of Sundays and holidays, provided the contractor uses standard manufacturer's mufflers and noise-reducing equipment in proper working order. Work outside those windows requires a special permit approved by the city, and emergency work by public service utilities is exempt outright.

Enforcement runs through Section 42-84: the code enforcement officer and police department share responsibility, isolated violations draw a police citation, and continuous or recurring violations go to the special magistrate under Section 2-206 et seq. Any owner, tenant, lessee, manager, or agent in lawful possession of the property is individually responsible and cannot escape punishment by pointing to another person as the actual source of the noise.
